Gorsuch Will Not Shift The Balance Of Power On The Supreme Court As Much As You May Think

Neil Gorsuch And Donald Trump - Public DomainOn Tuesday, President Trump announced that he would nominate Neil Gorsuch to fill the open seat on the U.S. Supreme Court.  Gorsuch currently serves on the 10th U.S. Circuit Court of Appeals in Denver, and he was confirmed unanimously by the Senate when he was appointed to that position by President George W. Bush in 2006.  Gorsuch appears to have some strong similarities to Antonin Scalia, and many conservatives are hoping that when Gorsuch fills Scalia’s seat that it will represent a shift in the balance of power on the Supreme Court.  Because for almost a year, the court has been operating with only eight justices.  Four of them were nominated by Republican presidents and four of them were nominated by Democrats, and so many Republicans are anticipating that there will now be a Supreme Court majority for conservatives.

Unfortunately, things are not that simple, because a couple of the “conservative” justices are not actually very conservative at all.

For example, it is important to remember that Scalia was still on the court when the Supreme Court decision that forced all 50 states to legalize gay marriage was decided.  Justice Anthony Kennedy joined the four liberal justices in a majority opinion that Scalia harshly criticized.  So with Gorsuch on the court, that case would still have been decided the exact same way.

Sadly, even though Kennedy was nominated by Ronald Reagan, he has turned out to be quite liberal.  In the past, not nearly enough scrutiny was given to justices that were nominated by Republican presidents, and a few of them have turned out to be total disasters.

And let us also remember that Scalia was still on the court when the big Obamacare case was decided.  Chief Justice John Roberts joined the four liberal justices in a decision that was perhaps one of the most bizarre in the modern history of the U.S. Supreme Court.

For some reason, Justice Roberts was determined to preserve Obamacare, and if you read what he wrote it is some of the most twisted legal reasoning that I have ever come across.

As someone that was once part of the legal world, let me let you in on a little secret.  Most judges simply do whatever they feel like doing, and then they will try to find a way to justify their decisions.  So if you ever find yourself in court, you should pray that you will get a judge that is sympathetic to your cause.

Fortunately, Gorsuch appears to be one of the rare breed of judges that actually cares what the U.S. Constitution and our laws have to say.  In that respect, he is very much like Scalia

Gorsuch is seen by analysts as a jurist similar to Scalia, who died on Feb. 13, 2016. Scalia, praised by Gorsuch as “a lion of the law,” was known not only for his hard-line conservatism but for interpreting the U.S. Constitution based on what he considered its original meaning, and laws as written by legislators. Like Scalia, Gorsuch is known for sharp writing skills.

“It is the role of judges to apply, not alter, the work of the people’s representatives,” Gorsuch said on Tuesday at the White House event announcing the nomination in remarks that echoed Scalia’s views.

One of the most high profile cases that Gorsuch was involved with came in 2013.  That was the famous “Hobby Lobby case”, and it represented a key turning point in the fight for religious freedom.  The following comes from CNN

In 2013, he joined in an opinion by the full Court of Appeals holding that federal law prohibited the Department of Health and Human Services from requiring closely-held, for-profit secular corporations to provide contraceptive coverage as part of their employer-sponsored health insurance plans.

And although a narrowly divided 5-4 Supreme Court would endorse that view (and affirm the 10th Circuit) the following year, Gorsuch wrote that he would have gone even further, and allowed not just the corporations, but the individual owners, to challenge the mandate.

Donald Trump said that he wanted a conservative judge in the mold of Scalia, but I think that he was also looking for someone that he could get through the Senate.

And considering the fact that Gorsuch was confirmed unanimously by the Senate in 2006 will make it quite difficult for Democrats to block him now.  Gorsuch has tremendous academic and professional credentials, and he will probably have a smoother road to confirmation than someone like appeals court judge William Pryor would

Trump may have favored Gorsuch for the job in hopes of a smoother confirmation process than for other potential candidates such as appeals court judge William Pryor, who has called the 1973 Supreme Court ruling legalizing abortion “the worst abomination of constitutional law in our history.”

But Pryor is still reportedly on the short list for the next spot on the Supreme Court that opens up, and by then the rancor in the Senate may have died down.

If Gorsuch is confirmed, what will this mean for some of the most important moral issues of our time?

As for abortion, even if Gorsuch is confirmed I do not believe that the votes are there to overturn Roe v. Wade.  But if Trump is able to nominate a couple more Supreme Court justices that could change.

But even if Roe v. Wade is overturned, it would not suddenly make abortion illegal.  Instead, all 50 states would then be free to make their own laws regarding abortion, and a solid majority of the states would continue to keep it legal.

The analysis is similar when we look at gay marriage.  If the Supreme Court decision legalizing gay marriage in all 50 states was overturned, each state would get to decide whether gay marriage should be legal or not for their own citizens.  And just like with abortion, it is likely that only a limited number of states would end up banning gay marriage.

So the nomination of Neil Gorsuch to the Supreme Court appears to be a positive step, but it does not mean that we are going to see dramatic change when it comes to issues such as abortion or gay marriage any time soon.

But at least Gorsuch can help stop the relentless march of the progressive agenda through our court system.  So in the end we may not make that much progress for right now, but at least the liberals won’t either.

    Incrementally. And if it means taking one step at a time with a scotus, and waiting on God to make the right “moves” for us, to get another like him; then that is better, actually way better, than being controlled and ram-shackled by liberal heathens at the helm.

    Abortion and gay marriage will disappear in America and the world, and there is nothing, absolutely nothing, anyone can do about it.They are extremely horrendous abominations unto our Creator, and as we get closer each day to putting the kings, Molech (god of innocent sacrifices), and Sodom, before the God of Abraham, Isaac, and Jacob; we will suffer more judgments upon this land and citizens.

    There is soon coming a day when the underworld will appear to have won the battle over these two issues, and we will reap the harvest of allowing such things to take center stage in a supposedly Christian and civilized Nation. However; that day will come and soon go, because of the return of “our” Lord and Saviour.

    As the flesh of all life piles up in the dirt from whence it came, ripping a screaming baby from it’s mother womb, and craving strange flesh by the fa>>ots of the world, will no longer be important. The focus will be on the King, that is about to separate the sheep from the goats.

    Look at the money situation and you will have a clear idea where out supreme court justices get their decisions from.
    The law is to lawyers a form of prostitution.
    The difference is only that the law is authorized and backed by the U.S. Government. They will do anything for money.
    Why bother justifying what they do?
    IF and that is a big IF, they were actually following law then the law would have been sent back to the Congress for a re-vote based on the fact that it was misrepresented. It was not represented as a tax.
    It might not have passed Congress if it had been.
    So the entire basis of the law is based on a lie.
    Any decent judge would have seen that and sent it back to the Congress.

    Author states that Roberts’ reasoning was “the most twisted legal reasoning that I have ever come across.” One lawyer to another, Amen. I practiced appellate law for a number of years (in Florida), and can say that even the appellate courts in that godforsaken legal arena would have been hard pressed to exercise such disingenuous legal reasoning. It was utterly demoralizing.

    Kennedy (80) has hinted at retirement and Ginsberg (83) is not likely to survive a second term of Trump she will likely die in office being so

    Gorsuch may prove to be an influential Justice and solidify the other conservatives in a way Scalia sometimes did not , although brilliant he was sometimes off putting with his abrasive style.

            First of all; I never said anything about salvation being dependent upon bloodlines. All peoples; nations and tongues, are covered by grace, for the availability to come to salvation. Even the sons of Cain…called Kenites, which are the bloodlines of Satan through Eve, to Cain, and all his offspring. Jesus Christ identified them (those that call themselves Jews, but are of the synagogue of Satan) that had “infiltrated” the Synagogues, and were working as scribes, and eventually wearing robes like the other infiltrators, the Nethinim, from the other mixed bloodlines of peoples called Canaanites.
            Even they could receive salvation because it is written “…whomsoever will”. That covers all flesh, even the giants/gebbor had the availability to turn their hearts to Jehovah. Did even one make the change? That is God’s business and only He has the answers.

            Your interpretation is bogus, because you infer that; because God will only show mercy on whom He wants, that he also only offers salvation to whomever He wants. WRONG!

Thus, we put no confidence = faith by the cutting away/ separation of the flesh. Thus putting not our faith in flesh works or flesh men.

            The scripture above, does not overshadow the truth that, “all flesh shall see salvation”. Which is to say that all flesh, after the Cross, will have an opportunity to hear about salvation/Jesus Christ, before the end.

        We have to have a check imho for our ways as mankind. I can’t realistically see diving into either side headlong. One more than the other I’ll give you that, but caution is imperative overall. The thing is….. where is the balance? Gay rights and the abortion issue have severely crippled the democratic side imho. Gays, well….. ones live as they will. However I don’t see them as a marriage. Not Biblical. Abortion…. I personally would hope it would never happen. But, maybe in certain circumstances…. ? Conditions should be placed upon it imho. ……… To me, aside from the things I’ve mentioned….. there are things to be respected from the left. Mainly the care and respect for the less fortunate. The concern for a decent days pay for a decent days work among the middle class. The middle class is of utmost importance for our economy.             There are different types of love Sunny. Three, or at least three of them are mentioned/described in the Bible. Eros, Agape, and Philia. There are also further breakdowns of the several definitions of love. The Agape type of love is what I’m referring to when I tell others (you included) I love them regarding their overall well-being and most importantly their eternal destiny. Check out the different definitions of love for yourself. Seriously, I’ll say it again. First of all…… seek God in your life sincerely and accept Christ into your life as your Savior. Then….. God will help you find a good man to be with in your life. As I said God helped lead me to my wife of nearly 25 years now. I’m very thankful to God for her.             O.K. I myself have been a democrat the past several years. Yet, all the while I personally can see answers from both sides of the aisle. Answers and problems from both. I consider myself a moderate. My mom for example…… I spoke with her two days ago. She’s more liberal than I am. Yet, she spoke to a man that stopped by their house a day before. He wanted to speak with them about a sign outside their house that my dad put up. ” Christians voted for Trump, Unbelievable”. I can relate to that in some degree, but I myself can see both sides of the coin. This man was a Mennonite and wanted to discuss Christian values. My mom did most of the talking. : ). They discussed the role of women in the church among other things. Women in the Mennonite church don’t have much of a say. They’re not to be preachers, not to pray…….. but can teach the kids in Sunday school. Of course my Mom begged to differ in these things. I do also. Mennonites don’t vote, they as a rule don’t serve in the military, etc. …. Anyway, that was my M&D’s encounter with one that wanted to offer his opinion. Not to put down the Mennonites, but offering that as an example. ………. My take in a nutshell is as follows. I believe in God. I own firearms. I believe in free speech. We must take care of the less fortunate and the elderly. I don’t look down upon others regarding race, economical position, their faith or otherwise. We are all created equal in God’s eyes. My hope is that we can find some way of getting along before it’s too late. We all have a say in the country. My concern is that we do it peacefully and hopefully can come to some agreements before it’s too late.

    Once the door to evil has been opened it is very hard to close it. Also, time is not on the side of conservatives on these social issues. The majority of the next generation all believe in homosexual “marriages” and killing unborn babies. So even if we get the federal government out of the issues, it will still be very hard to turn back the tide. The key is to reach out to the young people and have real revivals that would convert them en mass. That’s the only way we can hope to get back the nation to where it once was before.

    A former Obama administration official, now linked to a Soros-funded foundation, has suggested Donald Trump be declared mentally unfit to hold office or overthrown in a military coup.

    Rosa Brooks, who served as Counselor to the Under Secretary of Defense for Policy from 2009-2011 and as a senior adviser in the State Department, outlined four ways to remove President Donald Trump from office, most notably by having him declared mentally unfit for office or by launching a military coup.

    Encouraging news today on the heels of some discouraging news yesterday.

    yesterday, the fox news broadcast reports about how most Unions are bilking the consumers, by paying people/ union employees, to hold positions in trade unions, where their services and expertise is not even needed or utilized.

    In one case, and employer was forced to pay for an employee, that reaped a huge annual salary as a lubrication technician for a huge piece of construction equipment. The piece of equipment had become so advanced, that all joining surfaces that previously needed daily lubrication, was now self lubricating. The worker/lube tech, was now doing nothing but sometimes wiping dust off the big machine daily, and drawing a big salary, which with benefits, could easily reach $75 to $100 an hour.

    Eventually that costs is transferred to the taxpayer and consumer.
    The union has an incentive to keep as many “dues paying” employees on the companies payrolls as possible.

    Another story was about the construction of the new One world trade Center. As it was done with union laborers, one such job as Master mechanic was required, by the Union, to be on site at all times. This so-called mechanic’s services were never used by the company, yet he received an annual salary to the tune of $400k. More bilking.
    Millions and millions annually are bilked and passed on to the American taxpayer and consumer because of …Union Greed.

    The encouraging news is that Trump has now, reportedly, inquired of Scott Walker of Wisconsin for his advice on possibly gutting Federal Unions, which are bankrupting municipalities, with lucrative benefits packages, and excessive salaries.

    Time will tell.

      Sadly there’s corruption in the unions, or what’s left of them. My dad is a big ibew union member. Electrician. He did work his butt off the last ten years of his employment in particular. He was with them a total of some 37 years. He’s retired now. I was in the boilermakers union for some nine years after I exited the air force for about the same amount of time. Unions in the past fought with blood, sweat, and tears for the betterment of our working men and women pay wise and working conditions wise. …….. Nowadays what few unions there are, are in bed with the companies affording the members few benefits. ……… God help the working class for sure.

        Yep, I saw some of that first hand as a Teamster for a couple years. It was not a good experience, and the only thing that resulted, was a continual conflict between management and union members/workers.
        The exuberant benefits, especially the 30 year retirement packages members received, drove many companies into bankruptcy.

It comes after Qatar Airways was the first to say on Saturday morning it would allow previously banner passengers to fly to U.S. cities following the judge’s ruling. Air France, Etihad Airlines, Spain’s Iberia and German airline Lufthansa all followed suit. But the website of major Gulf airline Emirates still carried notices informing passengers of Trump’s original January 27 order.

    The White House slammed the judge’s ruling as ‘outrageous’ and vowed to appeal as soon as possible.
