Major Problems Announced At One Of The Largest Too Big To Fail Banks In The United States

Wells FargoDo you remember when our politicians promised to do something about the “too big to fail” banks?  Well, they didn’t, and now the chickens are coming home to roost.  On Thursday, it was announced that one of those “too big to fail” banks, Wells Fargo, has been slapped with 185 million dollars in penalties.  It turns out that for years their employees had been opening millions of bank and credit card accounts for customers without even telling them.  The goal was to meet sales goals, and customers were hit by surprise fees that they never intended to pay.  Some employees actually created false email addresses and false PIN numbers to sign customers up for accounts.  It was fraud on a scale that is hard to imagine, and now Wells Fargo finds itself embroiled in a major crisis.

There are six banks in America that basically dwarf all of the other banks – JPMorgan Chase, Citibank, Bank of America, Wells Fargo, Morgan Stanley and Goldman Sachs.  If a single one of those banks were to fail, it would be a catastrophe of unprecedented proportions for our financial system.  So we need these banks to be healthy and running well.  That is why what we just learned about Wells Fargo is so concerning…

Employees of Wells Fargo (WFC) boosted sales figures by covertly opening the accounts and funding them by transferring money from customers’ authorized accounts without permission, the Consumer Financial Protection Bureau, Office of the Comptroller of the Currency and Los Angeles city officials said.

An analysis by the San Francisco-headquartered bank found that its employees opened more than two million deposit and credit card accounts that may not have been authorized by consumers, the officials said. Many of the transfers ran up fees or other charges for the customers, even as they helped employees make incentive goals.

Wells Fargo says that 5,300 employees have been fired as a result of this conduct, and they are promising to clean things up.

Hopefully they will keep their word.

It is interesting to note that the largest shareholder in Wells Fargo is Berkshire Hathaway, and Berkshire Hathaway is run by Warren Buffett.  There has been a lot of debate about whether or not this penalty on Wells Fargo was severe enough, and it will be very interesting to hear what he has to say about this in the coming days…

Wells Fargo is the most valuable bank in America, worth just north of $250 billion. Berkshire Hathaway (BRKA), the investment firm run legendary investor Warren Buffett, is the company’s biggest shareholder.

“One wonders whether a penalty of $100 million is enough,” said David Vladeck, a Georgetown University law professor and former director of the Federal Trade Commission’s Bureau of Consumer Protection. “It sounds like a big number, but for a bank the size of Wells Fargo, it isn’t really.”

After the last crisis, we were told that we would never be put in a position again where the health of a single “too big to fail” institution could threaten to bring down our entire financial system.

But our politicians didn’t fix the “too big to fail” problem.

Instead it has gotten much, much worse.

Back in 2007, the five largest banks held 35 percent of all bank assets.  Today, that number is up to 44 percent

Since 1992, the total assets held by the five largest U.S. banks has increased by nearly fifteen times! Back then, the five largest banks held just 10 percent of the banking industry total. Today, JP Morgan alone holds over 12 percent of the industry total, a greater share than the five biggest banks put together in 1992.

Even in the midst of the global financial crisis, the largest U.S. banks managed to increase their hold on total bank industry assets. The assets held by the five largest banks in 2007 – $4.6 trillion – increased by more than 150 percent over the past 8 years. These five banks went from holding 35 percent of industry assets in 2007 to 44 percent today.

Meanwhile, nearly 2,000 smaller institutions have disappeared from our financial system since the beginning of the last crisis.

So the problem of “too big to fail” is now larger than ever.

Considering how reckless these big banks have been, it is inevitable that one or more of them will fail at some point.  When that takes place, it will make the collapse of Lehman Brothers look like a Sunday picnic.

And with each passing day, the rumblings of a new financial crisis grow louder.  For example, this week we learned that commercial bankruptcy filings in the United States in August were up a whopping 29 percent compared to the same period a year ago…

In August, US commercial bankruptcy filings jumped 29% from a year ago to 3,199, the 10th month in a row of year-over-year increases, the American Bankruptcy Institute, in partnership with Epiq Systems, reported today.

There’s money to be made. While stockholders and some creditors get raked over the coals, lawyers make a killing on fees. And some folks on the inside track, hedge funds, and private equity firms can make a killing picking up assets for cents on the dollar.

Companies are going bankrupt at a rate that we haven’t seen since the last financial crisis, but nobody seems concerned.

Back in 2007 and early 2008, Federal Reserve Chair Ben Bernanke, President Bush and a whole host of “experts” assured us that everything was going to be just fine and that a recession was not coming.

Today, Federal Reserve Chair Janet Yellen, Barack Obama and a whole host of “experts” are assuring us that everything is going to be just fine and that a recession is not coming.

I hope that they are right.

I really do.

But there is a reason why so many firms are filing for bankruptcy, and there is a reason why so many Americans are getting behind on their auto loans.

Our giant debt bubble is beginning to burst, and this is going to cause a tremendous amount of financial chaos.

Let us just hope that the “too big to fail” banks can handle the stress this time around.

    5300 employees opened 2 million fake accounts and credit cards?? That’s 350+ per employee! How in the world did something that large scale not get picked up by auditors? Plus, that’s 2% of their employees that were either involved or failed to notice/report the wrong doing. That’s a lot of corruption for one company. Unbelievable…

      I’m still shaking my head over this. What the heck were their auditors doing? Good Lord… I cant even tie my shoes at work without an auditor questioning me about it 6 months later. Also, Wells Fargo shares were up after this news broke. Just goes to show you how out of touch the stock market is with reality. “Widespread fraud and corruption? Who cares?! The penalty was only $185M so let’s BUY!”

        Lately, bad news always seems to result in higher share prices. My opinion is it is a way of warning the “short sellers” off the market. This would also mean it really isn’t a true buyer purchasing, but someone who can likely print money at will to keep the market going and steady at a level “they” want. Just a thought!

      I think you would be surprised by what auditors, especially external auditors, actually look at. It isn’t what you think and it explains why there is so much corruption in financial statements that goes unnoticed, or is often passed on to keep peace between external auditors and the corporate brass. A war there is a hassle for everyone.
      There can be a definite difference between what internal auditors and external auditors look at, or not, and depending on your position, this might explain part of your second post.

        I’m an A/R Manager so I get to work with both internal & external auditors – they each come once a year, so I get to enjoy their presence every 6 months 🙂 They look at processes, policies, approvals based on DOA guidelines, and sample transactions. They ask to see credit applications and test new account creations. I can’t imagine how deep the corruption must have been within this organization for that many fraudulent accounts to be opened without anybody at any level raising an eyebrow.

          I would suspect they are checking your work to make sure the IC processes are effective and you have the necessary documentation authorizing addtional accounts. That does not mean either external or internal auditors go back to the bank’s client to ensure they actually requested an account.

          The only way to see if a credit application is fraudulent is to speak to the person submitting the application, the bank client or request confirmations of accounts from them. Responses for this kind of testing are often not very good, so external auditors may not bother as the lack of responses means the procedure may not be relied upon.

          Again, I don’t know exactly what sort of system WF runs but I’d be concerned about the branch managers being in on the scam. It seems some would have had to have been in on it or willingly looked the otherway. Either way, it is a breakdown in the IC system and seems it could impact the external auditor’s report, though it will depend on the dollar amounts involved. Fraudulent accounts that have small to no balances don’t mean much. I may have to request a copy of the 10-K!

            It seems to me entire branches would have to have been involved for nobody within the chain of command to stop it.

            imo, many companies have put in place incentive plans that actually encourage practices such as this and even possible collusion among personnel. I’m not sure how aware either the BoD, management, or auditors are regarding such incentives and possible perverse impacts. They are likely far more widespread than thought. Finding fraud is often not easy. The old saying goes, “It takes one to know one!”

      The writing is on the wall GSOB. I believe that the emphasis is more biblical than natural. As we draw closer to the Jubilee year more and more of what man has tried to hide is coming to light. The light that now shines on their nefarious deeds is becoming visible to all who have been defrauded.

    Whew! I almost opened an account with them in 2015 but didn’t when I found out they directly contribute to planned parenthood. The higher ups had to know about this scam. Something of this size and magnitude doesn’t happen without management knowing. There needs to be prosecutions as well as fines and firings. How many top dogs in included in the 5300 firings? Bet not many.

      The top dogs are the ones who made the call to open the accounts. I’m sure one little account specialist woke up one day and said, “Hmm, I’m going to make Wells Fargo a lot of money today!” Send the big bankers a message by putting them in general lockup, not the country club style lockup.

      If a company goes down after a bank collapse, people will blame the bank. If the auditors are focussed on a bank chances are your bad practises will be overlooked. People are praying for someone else to get the blame and in my experience don’t even take responsibility for their own work. Of course the banks will say “who could have foreseen these events” and blame the regulators.

    What ever happened to fudicial responsibility in banks? Legally that is defined as “the relationship wherein one person has an obligation to act for another’s benefit.” Banks (and other financial institutions) used to have to meet those requirements!

    Debt and greed go hand in hand. In this Babylonian environment, there are the paid con artist that seek to improve the bottom line regardless of the path to get there.

    When greed is at the heart of business, especially banking, it isn’t hard to find willing participants that will look the other way. Rock the boat, and go to the basement to work or to the unemployment line.

    Auditors? Same thing. Play along and receive recommendations and raises, or trade places with the tens of thousands waiting in line for your job.

    Knowingly playing along with wrong doing, is just like turning the other way, and playing dumb about acknowledging it.

    The same thing goes with voting, it has to do with one’s conscience. Voting blindly/ignorantly, for a liberal agenda that kills innocent lives in the womb, does not relieve one from guilt by association, especially when the auditing of the books in Heaven are opened.

    Bank Auditors and Managers that knew innocent customers were being set up and robbed, are just as guilty, or more so, than the employees that were actually doing it for gain. It may seem like simple little things to the people involved, even by association, but it is still wrong and therefore it is still sin. All sin, not accounted for and redeemed for, is sin that is written in the Book, and will be part of the tally on Judgment Day.

            Yea, and 490 sins in a day, now that would be a lot of sinning. I guess if a person working for a WFargo Bank,
            set up 490 bogus accounts for customers, that charged fees, without the customer approval, that would be a form of thievery in which said employee would be sinning against each account/customer; therefore it would constitute a possible record # of sins.
            Whoa, I never considered it even possible, even by a prostitute, but assuming it happened in the aforementioned context of robbery; yep it is possible.

          We’re all headed for very tough times regardless of our political stance JCT. The Bible doesn’t say ones that vote Rep are clear of this. Just saying. During the Trib for example God will be punishing the ones w/the mark while they will be persecuting we the Christians. It’ll be Hell on earth. I would hope we’re gone before that time comes, but from what I read in the Bible that isn’t so. Anyway…. to politics (gag). I don’t like the Dem side and their being for abortion, gay rights, etc., but I also don’t like the Rep’s and their being for the big corp’s and squashing the worker…. the little guys out here. The Rep’s “trickle down theory” created by Reagan is just that. The worker only receives a small amount after the big guys on top suck most of it up. Lowering corporate taxes doesn’t translate to more jobs either. Guess they just pocket most of the savings on top. There’s a Dem Christian group here in the states I’ve heard…..             To be clear, I never said a vote for a Republican candidate was a biblical vote; what I said was one has to vote their conscience…or not vote at all.

      I highly doubt the CEO and his cronies didn’t know about it. They also benefited somehow. I think everyone in that bank except for the tellers need to be fired and investigated as to their involvement. I think that the number is much larger. Usually it is at least 2 times, maybe 3 times the amount. I wouldn’t be surprised if it is found out that 20,000 employees were involved.

    With 5,300 employees fired for this behavior, this isn’t an anomaly there. This has to be part of their corporate culture. Before the financial crash in ’08, I had a Wells Fargo credit card. They were the nicest people to work with and it was my favorite card. After they merged with Wachovia (sp?) they turned into the biggest jerks. It wasn’t possible to pay a monthly statement without incurring some kind of penalty fee. I paid off and cancelled as quickly as I could.

    Now we see what that change in culture had yielded.

The family is kinda split up regrettably. I’ve been several places while in the service years ago, but not Florida. England to Hawaii and points in between stateside (Calif./Ariz./Kan./etc.) are some of my past residences.
